The following terms and conditions govern the use of the website and services of KlarBudget. By using this website or engaging our services, you accept these terms in full.
1. General Information
These Terms & Conditions ("Terms") govern the contractual relationship between KlarBudget, Leopoldstraße 47, 80802 München, Germany ("KlarBudget", "we", "us") and you as a user of our website ("klarbudget.com") and as a recipient of our budget planning, allocation and financial advisory services (together the "Services"). These Terms apply exclusively; deviating terms of the client shall only apply if confirmed by KlarBudget in writing.
KlarBudget provides financial planning and advisory services. Our Services do not constitute legal, tax, investment or accounting advice within the meaning of statutory advisory regulations unless expressly agreed in writing.
2. Contract Formation
The presentation of our Services on this website does not constitute a binding offer but an invitation to submit an inquiry. A contract between you and KlarBudget is concluded only when we confirm your order or engagement in writing (including by email) or begin performing the Services.
The scope, fees and duration of each engagement are governed by the individual agreement, offer or service description accepted by you. Individual agreements take precedence over these Terms.
3. Services
KlarBudget supports companies with structured budget planning, budget allocation, spend tracking, forecasting and ongoing financial oversight. We perform our Services with the care of a prudent business and in accordance with current professional standards.
Forecasts, scenario models and recommendations are based on the data and information provided by you and on reasonable assumptions. They do not constitute a guarantee of future results. KlarBudget is not obliged to achieve particular financial outcomes.
4. Client Obligations
- You shall provide KlarBudget timely and completely with all data, documents and information necessary for the performance of the Services and ensure their accuracy.
- You shall designate a competent contact person for the coordination of the engagement.
- You shall notify KlarBudget without undue delay of any circumstances that may affect the performance of the Services.
If a delay in the provision of the Services results from a breach of your obligations, agreed deadlines shall be extended accordingly.
5. Fees and Payment Terms
All fees are stated net plus statutory VAT. Unless otherwise agreed in writing, fees are invoiced monthly in arrears or according to the agreed project schedule and are payable within 14 days of the invoice date.
In the event of default in payment, KlarBudget is entitled to charge statutory default interest. Further statutory rights remain unaffected.
6. Right of Withdrawal for Consumers
If you conclude the contract as a consumer (i.e. for purposes that are predominantly outside your trade, business or profession), you may have a statutory right of withdrawal for distance contracts. The specific withdrawal policy, including the withdrawal period and procedure, will be communicated to you at the time of contract formation. Statutory rights remain unaffected.
7. Intellectual Property
All content on this website, including texts, graphics, logos, templates and software, is the property of KlarBudget or its licensors and is protected by copyright and other intellectual property laws. Any reproduction, distribution or use beyond personal, non-commercial use requires our prior written consent.
Work results (such as budget models, analyses and reports) created specifically for you within the scope of an engagement may be used by you for your internal business purposes after full payment of the agreed fees.
8. Data Protection
KlarBudget processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). 9. Confidentiality
Both parties shall keep confidential all confidential information of the other party that becomes known in the course of the cooperation and shall use it only for the purpose of the engagement. The confidentiality obligation continues to apply after the end of the contractual relationship and does not extend to information that is publicly available without breach of these Terms or must be disclosed by law.
10. Liability
KlarBudget is liable without limitation for damages caused intentionally or by gross negligence, for damages resulting from injury to life, body or health, and in accordance with the provisions of the German Product Liability Act (ProdHaftG).
In the event of slight negligence, KlarBudget is liable only for breach of a material contractual obligation (cardinal duty), the fulfilment of which is essential for the proper execution of the contract and on whose compliance you may regularly rely. In such cases, liability is limited to the foreseeable damage typical for this type of contract, at most to the amount of the fees agreed for the respective engagement.
Liability for indirect damage, consequential damage or loss of profit is excluded to the extent permitted by law. These limitations of liability do not apply in the case of an assumed guarantee or where mandatory statutory provisions provide otherwise.
11. Website Availability and Content
KlarBudget strives to keep the information on this website accurate and up to date but does not warrant its completeness, accuracy or continuous availability. KlarBudget is entitled to modify, suspend or discontinue the website or parts of it at any time. Links to third-party websites are provided for information purposes only; KlarBudget assumes no responsibility for their content.
12. Contract Term and Termination
Engagements are concluded for the agreed duration. If no fixed term has been agreed, either party may terminate the engagement with two weeks' notice to the end of a month, without prejudice to the completion of ongoing individual services already commissioned. The right to terminate for cause remains unaffected. Upon termination, KlarBudget shall hand over the work results created up to that point, and fees for services rendered up to termination shall remain payable.
13. Final Provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to its economic purpose.
These Terms and all contracts concluded on the basis thereof are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes is Munich, Germany. If you are a consumer, the statutory places of jurisdiction apply.
